FAQ

What are the premium rates for each overtime type?

Please refer to the table below for overtime premium rates.

What is 'overtime within legal working hours'?

'Overtime within legal working hours' refers to overtime that does not exceed the 'legal working hours'.

When an employee works beyond the 'legal working hours', the excess is considered overtime.

Overtime within legal hours refers to overtime that 'does not exceed the legal working hours'.

For example, if there is a public holiday on Wednesday this week and an employee works 8 hours each on Mon, Tue, Thu, Fri + 4 hours on Saturday:

The employee is contracted to work 40 hours Mon-Fri, but with one public holiday, they only need to complete 32 actual working hours.

If they exceed 32 hours, the company must pay overtime premium. However,

even with 4 extra hours on Saturday, the total is 36 hours, which does not exceed the legal working limit of 40 hours. Therefore, the current administrative interpretation is that the 1.5x premium does not need to be applied.

In the above case, the overtime is calculated and displayed as 'overtime within legal hours' rather than regular 'overtime'.
